BarkAndBooty LLC Terms of Service

You give BarkAndBooty LLC staff permission to enter the residence and property to perform the service of providing pet waste pickup. This will include BarkAndBooty staff coming onto the property based on the agreed upon terms of service(s) to be provided. This includes the service(s) occurring based on any one of the following: 

A weekly basis (once a week), twice a week (on a weekly basis), bi-weekly (every other week) (**up to 3 dogs**), a one-time pickup service, and deodorizing spray service as requested by the client (if they choose deodorizing service). Pickup service will include clean-up and pick up of the waste from the property. Deodorizing spray service will include BarkAndBooty spraying areas of the residence and/or property. If the client wishes for specific areas to be sprayed, it is your responsibility to notify BarkAndBooty. 

BarkAndBooty LLC will dispose of the pet waste on the property. Please ensure BarkAndBooty LLC has access to a garbage bin so waste can be disposed of.

In order for service(s) to be provided, you give permission for BarkAndBooty LLC to have complete and clear access to the residence and a garbage bin on or near the property in order for services to be provided on the day of service. On the day of service, BarkAndBooty LLC will notify the client that they will be coming onto the residence and property to perform services. This will be in the form of any of the following: text message and/or email. 


BarkAndBooty LLC Hours 

BarkAndBooty LLC regular business hours are the following: 

Monday - Friday: 6:30 A.M. - 2:00 P.M.

Summer Hours: Monday - Friday: 6:30 A.M. - 1:00 P.M. 

Safety (Property)

It is your responsibility to ensure a safe environment for BarkAndBooty LLC to perform service(s). This includes a property free from obstructions that can prevent service(s) from being provided effectively. This includes but is not limited to the following: harmful items such as broken glass, construction materials, clutter of items where pet waste may be, overgrown plants and grass, and/or any other obstructions preventing BarkAndBooty LLC from providing service. BarkAndBooty LLC will not be responsible for any missed pet waste if a property is not free from obstructions that can prevent services from being provided as mentioned above.

Safety (Dog(s) on the Property) **(added February 7, 2024)**

On the day of service, it is your utmost responsibility to keep any and ALL pets inside. All pets are to be kept inside while service is being provided to ensure the safety of BarkAndBooty staff and the safety of any and all dog(s) on the property and residence. Failure and negligence to keep any and ALL dog(s) inside on the day of service will result in the service not being performed that day. BarkAndBooty LLC will notify the client if this occurs. 

If the dog is in the yard when BarkAndBooty staff arrive, service(s) will not be performed. This includes any dog(s) that have not been approved after a proper meet and greet. If you are unable to secure the dog(s) inside for the duration of the service, it can result in the termination of service(s). BarkAndBooty LLC will notify the client if this occurs. 

As a client, if you would like your dog(s) to be outside during service, BarkAndBooty LLC requires a meet and greet. It is your responsibility to notify BarkAndBooty LLC. This is to ensure the safety of BarkAndBooty LLC staff and your beloved pets. BarkAndBooty LLC will set a day and time for the meet and greet. If approved, your dog(s) may be outside during service. In the event your dog(s) is ever aggressive including but not limited to: running towards staff with teeth showing, hackles/hair raised, cornering BarkAndBooty LLC staff, and/or attempting to bite them, BarkAndBooty LLC will require the dog(s) be kept inside the property (not outside) for any service(s) going forward. If you are unable to secure the dog(s) inside for the duration of the service, it can result in the termination of service(s). BarkAndBooty LLC will notify you if this occurs.

You acknowledge that you are legally obligated to cover all costs involved with any injury caused to BarkAndBooty LLC staff due to any negligence in this matter.

Gate Safety/Security **(added February 7, 2024)**

Safety is a priority for BarkAndBooty LLC, ensuring safety measures are incorporated to make sure your dog(s) is/are contained properly on the residence. BarkAndBooty LLC will always send a picture of the gate locked/latched after service(s) has been provided. If the gate is not latching/closing correctly, BarkAndBooty LLC will notify the client. Once BarkAndBooty LLC has notified the client, it is your responsibility to fix gate before the next scheduled service day. If the gate is not fixed by the next scheduled service day, BarkAndBooty LLC will not be able to provide service(s) due to a safety concern of the dog(s) potentially getting loose from the property due to the gate not closing and/or latching properly. BarkAndBooty LLC will notify the client of the safety concern for the dog(s). BarkAndBooty LLC will double up on the next agreed date of service to provide the missed service and/or until the gate/latch is properly fixed.

BarkAndBooty LLC will not provide a refund if they are unable to perform  service(s) due to: any or ALL dogs being outside during the date and time of service (if not approved after a proper meet and greet), if BarkAndBooty LLC is not able to access the client's property, and/or if a gate/latch has not been fixed (if applicable). BarkAndBooty LLC will double up on the next agreed date of service to provide the missed service and/or until the above have been corrected. 

Prices/Onboarding

Anyone inquiring about services will receive an invoice quote that is good for seven days from the day it was sent. If the individual does not onboard for service after seven days, a new invoice inquiry form will be sent if they inquire again. Prices may vary due to operational costs and market adjustments. BarkAndBooty LLC will assess price adjustments due to operational costs and market adjustments March 1st of every year. If needed, new price adjustments will reflect on the website and the invoice line items. Any existing customers will receive a notification of such changes before March 1st. Price adjustments will show on the next recurring invoice statement. 

The service day is subject to change due to inclement weather (extreme heat, monsoon, and lightning), routing adjustments, or other unforeseen circumstances. BarkAndBooty LLC will inform the client(s) as soon as possible. Service will be provided as a double duty on the next scheduled day of service. 

Offers/Discounts

BarkAndBooty LLC offers the following promotional offer(s) and/or discount(s):

$15 off the first month of pickup for new customers that sign up. This includes pickup for the following service options: weekly basis (once a week), twice a week (on a weekly basis), and bi-weekly (every other week). The discount excludes one-time pickups and deodorizing spray service.  The discount will be a one-time discount applied to new customers on their initial recurring monthly invoice sent to them when they sign up. 

BarkAndBooty LLC offers a 10% recurring discount to seniors (65+) and to former and current U.S. military personnel. A potential client asking for the 10% off recurring discount will need to provide proof of identification in order to receive the recurring discount. **(excludes one-time pickups and deodorizing spray service)**

BarkAndBooty offers a referral program. Any new client(s) that onboard with BarkAndBooty LLC via a referral (current client with BarkAndBooty LLC) will receive $15 off their first month of service. The referrer will also receive a $15 refund/credit on their next recurring invoice. 

Promotional offers and/or discounts excludes one-time pickups and deodorizing spray service. 

Discounts, offers, and promotions cannot be combined. 

Payment

You acknowledge and agree to provide payment to BarkAndBooty LLC once a month. You agree to sign up for automatic, monthly recurring payments on the payment provider service, Stripe. BarkAndBooty LLC will provide a monthly invoice to be charged based on the following service(s) provided: weekly (once a week), twice a week (on a weekly basis), bi-weekly (every other week), and deodorizing spray service (if applicable). Payment is due on the due date provided on the invoice. BarkAndBooty LLC will not be able to provide service(s) if an invoice is not paid by the due date. It is the client's responsibility to notify BarkAndBooty LLC of any changes to payment.

Initial Pick-up Fee: A first-visit fee of $10.00 will be applied since BarkAndBooty will be servicing the client for the first time. This is a one-time fee that will be added to the initial invoice sent to the client. 

**BarkAndBooty LLC will notify a client if there is more waste picked on the property than indicated by the client (via the inquiry form) on the first visit to the property. If this occurs, BarkAndBooty LLC will notify the client while service is being provided based on their preferred method of contact if this occurs as more waste will be picked up than indicated. A fee of $60.00 will automatically be charged by BarkAndBooty LLC via Stripe, the payment service provider used by BarkAndBooty LLC. This will be in the form of a separate invoice to be charged on the service day via Stripe. 

One-time pick-up services will be charged a deposit fee of $60.00 for the first 30 minutes of service before service is provided. Service will not be provided unless the deposit fee is paid. One-time pick-up services fee will apply to backyards that have not been picked up in 14 days or more. 

You agree to have BarkAndBooty LLC charge your credit card automatically if clean up surpasses 30 minutes. There will be a $2.00 charge per every 1 minute. This is required for one-time pick-up services. 

BarkAndBooty LLC will charge your card for the one-time pickup service as follows: An initial invoice will be sent to the client, reflecting services rendered by BarkAndBooty LLC based on the following below:

**One-time pick service invoice(s) will be charged on the service day. **

Pick-Up For Restart of Service(s): BarkAndBooty LLC will charge a one-time Pick-Up For Restart of Service(s) fee of $60.00 if pet waste was not picked up during the discontinuation/pause of services. This is for any client that has discontinued/paused services with BarkAndBooty LLC where pet waste was not picked during the discontinuation/pause of services and they have decided to start services with BarkAndBooty LLC again.

You are responsible to pay for the agreed upon services with BarkAndBooty LLC by the due date provided on the invoice. Failure to provide payment by the provided due date will pause service(s) immediately. It is your responsibility to communicate with BarkAndBooty LLC if the payment method changes for one reason or another. Services will not be performed and completed by BarkAndBooty LLC on the scheduled date of service due to lack of payment. If services are halted until payment is provided and received, this can change the date and time services can be provided by BarkAndBooty LLC. Once payment has been provided and received, BarkAndBooty LLC will discuss to continuation of services. 

Changes on the Amount of Dogs (Pet Waste Pickup) Serviced

It is your responsibility to notify BarkAndBooty LLC if the amount of dogs serviced changes for any of the following reasons: adoption/rehoming of a dog, if a beloved dog has passed away, and/or any visiting (short-term) dog(s) staying on your property. You must notify BarkAndBooty LLC so the changes can properly and accurately reflect in the invoice for services being provided. Failure to do so will result in additional charges. 

If there is a new addition of a dog(s), you must notify BarkAndBooty LLC before the next service day scheduled. Failure to notify BarkAndBooty LLC of additional dogs will result in being charged the price difference for the service(s) performed where additional dog(s) are on the property. 

If BarkAndBooty LLC notices there is more pet waste pickup than normal, BarkAndBooty LLC will notify the client via their preferred method of contact if this occurs along with a picture to show additional pet waste. Adjusted service fees will automatically be charged as an extra dog fee ($5.00) by BarkAndBooty LLC via Stripe, the payment service provider used by BarkAndBooty LLC. This will be in the form of a separate invoice to be charged on the same service day. BarkAndBooty LLC will notify the client via their preferred method of contact. It is your responsibility to notify BarkAndBooty LLC of any changes. 

Acknowledgement of Legal Action for Non-Payment

You acknowledge and understand that BarkAndBooty LLC may file a claim with Arizona Small Claims Court after 30 days of non-payment in an attempt to legally collect the debt owed. You are responsible for any and all legal fees associated with the nonpayment case. The city in which you reside in will be contacted by BarkAndBooty LLC to press charges for Theft of Services which is a misdemeanor crime in the state of Arizona. 

Discontinuation/Pausing of Services

It is your right and responsibility to notify BarkAndBooty LLC when you wish for services to no longer be provided. If you wish for services to no longer be provided, it is your responsibility to notify BarkAndBooty LLC one week before the next service date to be provided. Notifying BarkAndBooty LLC one week before the next service date will allow them to stop recurring payments and discontinue service. A refund will not be provided as the service(s) been paid for in advance (monthly recurring payment). Service will continue to be performed through the end of the billing cycle unless you as the client decide not to have service provided upon notice to BarkAndBooty LLC. You must notify BarkAndBooty LLC or service will be provided until the billing cycle is complete. 

If you need service to be paused due to any circumstances, it is your responsibility to notify BarkAndBooty LLC before the next service day to be provided. BarkAndBooty will double up on service for the next scheduled day of service. 

It is your responsibility to pay for any missed service(s) during the time service was discontinued and/or paused if the pet waste has not been picked up. BarkAndBooty LLC will charge a: One-Time Pick-Up Restart of Service: a fee of $60.00 if pet waste was not picked up during the discontinuation/pause of services. This is for any clients that have discontinued/paused services with BarkAndBooty LLC where pet waste was not picked during the discontinuation/pause of services and they have decided to start services with BarkAndBooty LLC again.

Use of Pictures/Videos on Social Media

You agree to give BarkAndBooty LLC permission to take pictures and videos of area of the residence and/or property being services and dogs explicitly for the use of content to help advertise and promote BarkAndBooty LLC as a business. The content may be shared on one or more of the following social media platforms:

If you do not wish and/or do not give permission to have BarkAndBooty LLC use such content (pictures and videos), you MUST notify BarkAndBooty LLC before agreeing to the Terms of Service. If BarkAndBooty LLC is not notified, picture and video content will be used explicitly for the use of content to help advertise and promote BarkAndBooty LLC as a business. 

Observance of Holidays/Vacation

BarkAndBooty LLC reserves the right to take holidays, days off, and/or scheduled vacations. BarkAndBooty LLC observes and recognizes the following holidays:

If the day of service falls on a recognized holiday and/or day off, BarkAndBooty LLC will either service the client on a different day during the holiday week or double on duty on the next scheduled day of service. Clients will be notified a minimum of 2 weeks in advance if their scheduled service day falls on one of the day(s) mentioned above. 

BarkAndBooty LLC will notify clients of a planned vacation at a minimum of eight to six weeks before a planned vacation. If the service day provided falls on the vacation period, no service will be performed during the time period. Double duty service will be provided to pick up waste for the days missed when back from vacation. No refund will be provided due to double duty pickup.

A follow up reminder four weeks and a week before the vacation period will be sent to clients to remind them of the upcoming vacation period based on their preferred method of contact. 

Sickness

BarkAndBooty LLC strives to deliver the best service. Instances of sickness where BarkAndBooty LLC is not able to provide service may force BarkAndBooty LLC to reschedule services. BarkAndBooty will inform the client(s) as soon as possible. Service will be provided as a double duty on the next scheduled day of service.
